Agreement to These Terms

These Terms of Service ("Terms") are a legally binding agreement between you and Wealthy ("Company", "we", "us", or "our"). They govern your access to and use of the Wealthy application and any related services (collectively, the "Service").

By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use after changes take effect constitutes acceptance of the updated Terms.

The Service is intended for users who are at least 18 years old. If you are under 18, you may not create an account or use the Service.

1. Service Description

Wealthy is a privacy-first, manual-entry net worth tracker designed for intentional monthly financial check-ins. The Service allows you to track stocks, cryptocurrency, retirement accounts, cash accounts, budgets, expenses, and monthly financial snapshots.

Wealthy does not connect to your bank accounts, brokerage accounts, or any financial institution. All financial data is entered manually by you. Market prices for stocks and cryptocurrency are fetched from third-party data providers for display purposes only.

The Service is not financial advice. Wealthy is a tracking and organisational tool. You should consult a qualified financial adviser before making investment decisions. We make no representations about the accuracy or completeness of any market data displayed in the Service.

2. Account Registration

To use the Service, you must create an account using a valid email address, or by signing in through a third-party provider such as Google or Apple. You are responsible for maintaining the security of your account and for all activity that occurs under it.

You agree to provide accurate information when creating your account and to notify us promptly if you believe your account has been compromised.

When you sign in through a third-party provider such as Google or Apple, your use of that provider is also subject to their own terms of service and privacy policy.

3. Free Trial

New accounts receive a 30-day free trial with full access to all features. No payment information is required to start a trial. When the trial expires, you will need to subscribe to a paid plan to continue accessing the Service. Your data is retained after the trial ends, so you can subscribe at any time without losing your information.

4. Subscriptions and Billing

Plans and Pricing

Wealthy offers monthly and annual subscription plans. Current pricing is displayed on our pricing page. We may offer promotional or early supporter pricing at our discretion. We reserve the right to change pricing with reasonable notice to existing subscribers.

Payment Processing

All payments are processed by Lemon Squeezy, which acts as our Merchant of Record. Lemon Squeezy handles all billing, payment processing, tax compliance, and invoicing. When you subscribe, you provide your payment details directly to Lemon Squeezy. We do not store your credit card number, billing address, or other payment information on our servers.

Automatic Renewal

Your subscription renews automatically at the end of each billing period (monthly or annual) unless you cancel before the renewal date. You consent to recurring charges to your payment method on file with Lemon Squeezy.

Cancellation

You can cancel your subscription at any time from the Settings menu within the app. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until your paid period ends. After cancellation, your account becomes inactive but your data is retained.

Refunds

Refund requests are handled by Lemon Squeezy as our Merchant of Record. If you believe you are entitled to a refund, please contact us at support@wealthyapp.co and we will work with Lemon Squeezy to resolve your request.

5. Your Data

Data Ownership

You retain full ownership of all financial data you enter into Wealthy. We do not claim any intellectual property rights over your data. We store and process your data solely to provide the Service to you.

Data Export

You can export all of your data at any time via the Settings menu. Your data is exported as CSV files in a ZIP archive.

Data Accuracy

You are responsible for the accuracy of the financial data you enter. We provide market price data from third-party sources for informational purposes, but we do not guarantee its accuracy, timeliness, or completeness.

6. Account Deletion

You can request deletion of your account at any time by submitting a support request through the app. When we process your request, all of your data — including your account, financial entries, snapshots, and subscription records — is permanently and irreversibly deleted from our database. We recommend exporting your data before requesting deletion.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorised purpose.
• Attempt to gain unauthorised access to the Service, other accounts, or our systems.
• Use automated means (bots, scrapers, scripts) to access or interact with the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Reverse engineer, decompile, or disassemble any part of the Service, except as permitted by law.
• Use the Service to compete with Wealthy or for any commercial purpose beyond personal financial tracking.
• Circumvent or disable any security features of the Service.

8. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Wealthy and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial financial tracking purposes.

Feedback, suggestions, or ideas you submit about the Service may be used by us without obligation or compensation to you.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you agree to the practices described in the Privacy Policy.

10. Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time. We will provide reasonable notice of any significant changes or discontinuation where practicable.

11. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. MARKET DATA DISPLAYED IN THE SERVICE IS PROVIDED BY THIRD-PARTY SOURCES AND MAY BE DELAYED, INACCURATE, OR INCOMPLETE. THE SERVICE IS NOT FINANCIAL ADVICE AND SHOULD NOT BE RELIED UPON FOR INVESTMENT DECISIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEALTHY AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold harmless Wealthy and its officers, agents, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any law or the rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, disclaimers, limitation of liability, and indemnification.

15. Governing Law and Disputes

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Australia.

Before initiating formal proceedings, the parties agree to attempt to resolve any dispute informally for at least thirty (30) days by contacting us at support@wealthyapp.co.

16. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wealthy regarding the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision does not constitute a waiver of that right. We may assign our rights and obligations under these Terms at any time.
